Terms and Conditions of Purchase, Delivery and Returns
These Terms and Conditions govern purchases made through www.curtaincat.com.
By placing an order on curtaincat.com, the Customer confirms that they have read and accepted these Terms and Conditions.
1. Seller Information
The seller is:
UAB “BALTIC CONSULTANCY AND TRADING”
Company registration number: 302224530
VAT number: LT100007657316
Registered address: Taikos pr. 80-11, LT-51297 Kaunas, Lithuania
Email: info@curtaincat.com
Hereinafter referred to as the Seller.
A natural person purchasing goods for purposes outside their trade, business or profession is hereinafter referred to as the Consumer or Customer.
2. Products and Prices
The products available for purchase, their main characteristics, prices and available quantities are displayed on curtaincat.com.
All prices shown to consumers are in euros (EUR). The total price, including all applicable taxes and any additional charges, is displayed before the Customer places the order.
Product photographs are intended to represent the goods as accurately as possible. Slight differences in colour may occur due to lighting, photography and individual screen settings.
Curtain dimensions, materials, included accessories and other relevant product information are stated on the relevant product page.
The Seller may change product prices and offers at any time. Any such changes apply only to future orders and do not affect orders already concluded.
3. Placing an Order and Conclusion of the Contract
The Customer places an order by selecting the desired products, providing the required delivery information, selecting an available payment method and confirming the order.
Before confirming the order, the Customer has the opportunity to review and correct the information provided.
After the order is placed, the Customer receives an order confirmation at the email address provided during checkout.
The purchase contract is concluded when the Seller confirms the Customer's order by email.
If, exceptionally, an ordered product is unavailable or the Seller cannot fulfil the order, the Customer will be informed as soon as possible and any payment already received for the unavailable goods will be refunded.
4. Payment
Available payment methods are displayed during checkout.
The Customer will always see the final amount payable before confirming the order.
The Seller begins processing the order after successful payment or confirmation of payment, depending on the payment method selected.
Payment and personal information is processed in accordance with applicable data protection requirements and the Privacy Policy available on curtaincat.com.
5. Delivery
CurtainCat delivers orders to countries within the European Union.
Standard delivery within the European Union is free of charge, unless a different delivery charge is clearly stated before the order is placed.
Orders are normally delivered within 10–15 business days after the order has been confirmed and payment has been received.
Delivery times are estimates and may occasionally be affected by circumstances outside the Seller's reasonable control. If a significant delay occurs, the Seller will inform the Customer where possible.
The Customer is responsible for providing a complete and correct delivery address and contact information.
The Seller remains responsible for the goods until they are delivered to the Customer or another person designated by the Customer, except where the Customer independently arranges a carrier that was not offered by the Seller.
If delivery cannot be completed because the Customer supplied an incorrect or incomplete address, or repeatedly fails to accept delivery, reasonable additional costs resulting from a new delivery may be charged to the Customer.
The Customer should notify the Seller as soon as possible if a parcel appears damaged upon delivery or if goods are missing or damaged.
6. 14-Day Right of Withdrawal
Consumers purchasing online have the right to withdraw from the purchase contract within 14 days without giving any reason.
For goods, the 14-day withdrawal period begins on the day the Customer, or a third party designated by the Customer other than the carrier, receives the goods.
To exercise the right of withdrawal, the Customer must inform the Seller of the decision to withdraw before the 14-day period expires.
The Customer may do this by:
using the “Withdraw from contract here” function available on curtaincat.com, or sending a clear withdrawal statement by email to info@curtaincat.com.
The Customer may also use the Model Withdrawal Form provided at the end of these Terms, although use of the form is not mandatory.
7. Returning Goods After Withdrawal
After informing the Seller of the decision to withdraw, the Customer must return the goods without undue delay and no later than 14 days after notifying the Seller of the withdrawal.
Unless otherwise agreed, the Customer bears the direct cost of returning goods when exercising the 14-day right of withdrawal.
Please contact info@curtaincat.com before sending the return so that the Seller can provide the appropriate return instructions.
Goods should be securely packaged to prevent damage during return transport.
The Customer may inspect the goods in the same way as they would reasonably be able to inspect them in a physical shop.
The Customer is responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
If curtains have been cut, altered, washed, stained, damaged or used beyond what is reasonably necessary for inspection, the amount refunded may be reduced to reflect the resulting loss in value.
The absence or damage of the original packaging does not by itself remove the Consumer's statutory right of withdrawal, although the Customer should use the original packaging where reasonably possible in order to protect the goods during return transport.
This section does not affect the Customer's rights if the goods are faulty or do not conform to the contract.
8. Refunds Following Withdrawal
If the Customer validly withdraws from the contract, the Seller will refund all payments that must be refunded under applicable consumer law, including the standard delivery charge originally paid by the Customer, if any.
Because standard EU delivery offered by CurtainCat is normally free of charge, there will usually be no original delivery charge to refund.
If the Customer expressly chose a more expensive delivery option than the standard delivery offered by the Seller, the Seller is not required to refund the additional cost of that more expensive delivery option.
The refund will be made without undue delay and no later than 14 days after the Seller is informed of the Customer's decision to withdraw.
The Seller may withhold the refund until the returned goods have been received or until the Customer provides evidence that the goods have been sent back, whichever occurs first.
Unless otherwise agreed, the refund will be made using the same payment method used for the original purchase.
9. Faulty, Damaged or Non-Conforming Goods
Consumers benefit from the statutory legal guarantee provided under applicable EU and national consumer law.
New goods are covered by a minimum two-year legal guarantee from the date the goods are delivered.
If a product is faulty, damaged on arrival or does not correspond to its description, the Customer should contact:
Please include the order number and a description of the issue. Photographs may be requested where they can help identify the problem.
Depending on the circumstances and applicable law, available remedies may include repair, replacement, an appropriate price reduction or termination of the contract and refund.
Repair or replacement of legitimately faulty or non-conforming goods will be provided without cost to the Consumer, including necessary return or delivery costs.
The statutory legal guarantee is separate from and is not reduced by any additional statements made by CurtainCat about product durability.
10. Product Use, Installation and Care
CurtainCat curtains are designed for homes with cats and use a durable mesh structure intended to withstand scratching and climbing better than conventional delicate sheer curtains.
Actual durability depends on use, installation, care and the behaviour and weight of the individual cat.
If a cat climbs the curtains, the curtain rod, brackets and all wall or ceiling fixings must be securely installed and suitable for the additional load.
The Customer should regularly inspect the curtain rod, brackets, rings and curtain tape and discontinue climbing use if any part of the installation becomes loose or damaged.
CurtainCat curtains are not safety equipment and should not be used to support people or loads for which they were not designed.
Curtains should be cared for in accordance with the care instructions provided with the product or on curtaincat.com.
Damage resulting from incorrect installation, inappropriate use, failure to follow care instructions or normal wear and tear is not considered a product conformity defect unless otherwise required by applicable law.
Nothing in this section limits the Consumer's mandatory statutory rights.
11. Intellectual Property
Unless otherwise stated, all text, photographs, videos, graphics, logos, designs and other content available on curtaincat.com are owned by or lawfully used by the Seller.
Such content may not be reproduced, distributed, published or used for commercial purposes without prior written permission from the Seller, except where permitted by law.
12. Personal Data
Personal data collected in connection with orders and use of curtaincat.com is processed in accordance with applicable data protection law.
Information about the purposes of processing, legal bases, retention periods, recipients, cookies and Customer rights is provided in the Privacy Policy available on curtaincat.com.
13. Complaints
If the Customer has a question or complaint regarding an order, product or service, the Customer should first contact the Seller in writing at:
The Seller will examine the complaint and provide a reasoned response within the period required by applicable law and, for consumer complaints in Lithuania, no later than 14 calendar days after receiving the written complaint.
The Seller aims to resolve disputes directly and amicably wherever possible.
14. Alternative Dispute Resolution
If a Consumer and the Seller are unable to resolve a dispute directly, the Consumer may have the right to use an alternative consumer dispute resolution procedure.
In Lithuania, consumer disputes may be submitted to:
State Consumer Rights Protection Authority (SCRPA / VVTAT)
A. Goštauto str. 12
LT-01108 Vilnius
Lithuania
Website: https://vvtat.lrv.lt/
Consumer Rights Information System: https://www.vtis.lt/
Consumers residing in another EU Member State may also contact the European Consumer Centre in their country of residence for assistance with a cross-border consumer dispute.
15. Governing Law
These Terms and purchase contracts concluded through curtaincat.com are governed by the laws of the Republic of Lithuania.
However, where the Customer is a Consumer residing in another country and mandatory consumer protection provisions of that country apply, this choice of law does not deprive the Consumer of the protection provided by those mandatory provisions.
Nothing in these Terms limits any mandatory rights granted to Consumers under applicable EU or national consumer protection law.
16. Changes to These Terms
The Seller may update these Terms and Conditions from time to time, for example to reflect changes in law, payment methods, delivery arrangements or the operation of curtaincat.com.
The version of the Terms in force at the time the Customer places an order applies to that order.
Changes published after an order has been concluded do not retrospectively change the terms of that purchase contract.
